Disclaimer and Conditions for Using This Section

1. This Section contains information including Answers to Frequently Asked Questions (the Information) prepared by the Local Government Association of Tasmania (the LGAT) for and on behalf of the Local Councils of Tasmania (the Local Councils).

2. This disclaimer applies to the use of the Information by you or any person, corporation or other entity to whom you communicate the Information (jointly and severally referred to as "the User"). In accessing the Information the User agrees to be bound by the terms and conditions of this Disclaimer and Conditions For Using This Section. If you do not accept these Terms and Conditions, you must refrain from accessing or using the Information.

3.   Errors and Omissions

The Information has been formulated by interpreting various Acts, Regulations, By-Laws as well as published Council Policies, Guidelines and Practices (the Rules and Practices) and, while the Information has been formulated with all due care, neither the Local Councils nor the LGAT warrant or represent that the Information is free from errors or omissions.

4.  No Advice

The User agrees that neither the Local Councils nor the LGAT nor their respective officers, employees and agents are providing professional or legal advice by making the Information available to the User. Users will be responsible for making their own assessment of the Information and should independently verify all relevant representations, statements and information themselves for their accuracy, effect and currency. We recommend you seek advice from a suitably qualified professional.

5.    Disclaimer and Exclusion of Liability

5.1 Each of the Local Councils and the LGAT disclaim, to the fullest extent permitted by law, any liability whatsoever and howsoever arising, in relation to, or arising out of, the quality, accuracy and/or currency of the Information. For reasons of succinctness and presentation, the Information may be in the form of summaries and generalisations and may omit details that could be significant in a particular context or to particular persons.

5.2 The Information is made available on the understanding that the Local Councils and the LGAT and their respective officers, employees and agents shall, to the fullest extent permitted by law, have no liability (including but not limited to liability by reason of negligence including for personal injury or death) to the Users for all claims, loss, damage, suits, fines, penalties, expense or other costs whatsoever and howsoever caused, whether direct, indirect, consequential or special, in relation to, or arising out of, any person using or relying on the Information regardless of whether caused by reason of any error, omission or misrepresentation in the Information or any other matter whatsoever, howsoever caused.

6.   Indemnification

To the fullest extent permitted by law, the User agrees to indemnify and hold harmless each of the Local Councils and the LGAT, their officers, employees and agents from and against all claims, losses, damage, suits, fines, penalties, expenses or other costs whatsoever, howsoever caused, whether direct, indirect, consequential or special, including legal fees, in relation to, or arising out of, the User's use of the Information.

7.   Amendments to Information and Exclusion of Liability

7.1 Whilst the Information is considered to be true and correct at the date of publication, changes in the Rules and Practices after the time of publication may impact upon the accuracy of the Information. Prior to acting upon the Information the User should first contact the relevant Local Council to ensure that the Information the User intends to act upon is still current.

7.2 The Information may change without notice and neither the Local Councils nor the LGAT accept any liability whatsoever, howsoever caused, in relation to, or arising out of, the accuracy and currency of any information printed, downloaded, displayed, copied, stored or otherwise used or distributed by a User.

8.   Linked Web Sites and Exclusion of Liability

As part of the Information, links may be provided to other Internet sites. These external information sources are outside the control of the Local Councils and the LGAT and it is the responsibility of the User to determine the accuracy, reliability and correctness of information available on those external Internet links. Each of the Local Councils and the LGAT disclaim, to the fullest extent permitted by law, any liability whatsoever, howsoever caused, in relation to, or arising out of, the quality, accuracy and/or currency of the information available on those external Internet links. Furthermore, although links are provided to the Rules and Practices available in electronic form, there may be other Rules and Practices relevant to the User's purposes that are not in electronic form or not referenced in the Information. Prior to acting upon the Information, the User should first obtain advice from a suitably qualified professional.

9.  Copyright and Restrictions on use of Information

Copyright in the Information is retained by the George Town Council and LGAT.  Users may print, download, display, copy and store any part of the Information in unaltered form only. Users may not transmit, distribute or commercialise the Information without the express written consent of the George Town Council and LGAT.

10.  Provisions Severable

If any conditions or part of any conditions of this disclaimer and conditions of using this package are unenforceable under law such unenforceability shall not affect any other part of this disclaimer and conditions of using this package.
